Commission finds tax rulings in favour of Fiat and Starbucks to be illegal State aid

Hot off the press, here is today’s press release from the Commission, announcing negative decisions in relation to tax rulings issued by Luxembourg, in relation to Fiat, and the Netherlands, in relation to Starbucks. The decisions conclude formal investigations that were commenced in June 2014. The press release indicates that each of the two companies will have to repay between €20-€30 million of unlawful aid, although the precise amounts are now to be determined by the Luxembourg and Dutch tax authorities.

The decisions will in due course be published on the Commission’s website, once confidentiality redactions have been made.

Three further similar investigations are still pending in respect of Apple (Ireland), Amazon (Luxembourg) and a Belgian tax scheme.
